KOMPAREJET is a brand of PRIVATE JETS AND PARTNERS.  

KOMPAREJET offers a personalized subscription service allowing our users to access a business aircraft comparison via the Internet on computers and other connected devices.  

These Terms of Use govern your use of our service. As used herein, the terms "Komparejet service", "Komparejet" or "subscription" refer to the personalized service provided by Private Jets & Partners via the KOMPAREJET brand for comparing, booking and accessing private jets, including all features, recommendations and reviews, our websites and user interfaces, and all content and software associated with our service.

1. Subscription  

1.1. Your subscription to the KOMPAREJET service shall continue until terminated. To use the KOMPAREJET service, you must have Internet access and a device compatible with KOMPAREJET, and you must provide us with one or more Payment Methods. A "Payment Method" means a current, valid, accepted payment method that may be updated from time to time. Unless you terminate your subscription prior to your billing date, you authorize us to bill you for the subscription fees for the next billing cycle via your Payment Method (see "Termination" below). 

1.2 We may offer different subscription packages. Some subscription plans may have different terms and restrictions, which you will be informed of at the time of registration or in other communications made available to you. You will find specific details of your KOMPAREJET subscription by visiting the komparejet.com website and clicking on the "Customer Area" link available at the top of the pages.  

1.3. Unless expressly stated otherwise, Komparejet will not refund subscriptions that have been purchased. You agree that we may begin providing the service immediately, and that you are not entitled to a cancellation period, except where applicable law requires a cooling off period despite your waiver and even where a service begins immediately. You may, however, cancel your subscription as described in the "Termination" section below. 

2. Billing and resiliation of KOMPAREJET subscriptions  

2.1. Billing cycle. Subscription fees for the KOMPAREJET service will be billed via your Payment Method on the specific payment date indicated on the "Customer Area" page. The length of your billing cycle depends on the type of subscription you chose when you signed up for the Service. In some cases, your payment date may change, for example, if your Payment Method did not work, when you change your plan, or if your paid subscription started on a day that is not in a given month. Please go to the komparejet.com website and click on the "invoice" link on the "Customer Area" page to find out when your next billing will be. 

2.2 Payment methods. To use the KOMPAREJET service, you must provide us with one or more Payment Methods. You authorize us to debit your account via any Payment Method associated with your account in the event that your primary Payment Method is declined or no longer available to us for payment of your subscription fees. You are responsible for any amount not collected. If a payment fails to clear due to card expiration, insufficient balance, or for any other reason, and you do not terminate your account, we may suspend your access to our service until we have successfully debited your account via a valid Payment Method. For some Payment Methods, the Provider may charge you certain fees, such as fees on international transactions or other fees related to processing your Payment Method. Fees for local taxes may vary depending on the Payment Method used. Please contact your Payment Method provider for more information.  

2.3 Updating Your Payment Methods. You can update your Payment Methods by visiting the "Customer Area" page. We may also update your Payment Methods with information provided by payment service providers. After any update, you authorize us to continue charging your account through the relevant Payment Method(s). 

2.4. Resiliation. You may terminate your Komparejet subscription at any time and you will continue to have access to the service until the end of your billing period. Payments are non-refundable and we do not provide refunds or credits for periods of partial use, or for any Komparejet content used. To cancel your subscription, go to the "Customer Area" page and follow the instructions. If you cancel your subscription, your account will be automatically closed at the end of your current billing period. To find out when your account will be closed, please click on "Billing" in the "Customer Area".  

2.5. Price and Subscription Changes. We may change our subscriptions and the price of our service from time to time. However, any changes to pricing or your subscriptions will only be effective after a minimum of 30 days following receipt of notification from us. 

3. Using the KOMPAREJET service  

Komparejet is an online search platform, which allows its subscribers to access Komparejet's search capabilities to locate available private jets for the date and itinerary selected by the user, subject to the operator's fares and terms and conditions, and to view available information collected by Komparejet on those jets. 

3.1. You must be at least 18 years old to subscribe to the Private Jets & Partners service. 

3.2. The Komparejet service, as well as any content you access through the service, is for personal, non-commercial use only and may not be shared with anyone outside your household.  

3.3. You may not duplicate or distribute any data found on the Komparejet platform without the prior written consent of Komparejet. 

3.4. We will provide you with a username and password or IP restriction. You are responsible for not disclosing the username, password or IP address to any other person and for monitoring your account for any use that is not yours. If you do not remember your username or password, or if you become aware that someone else is using your username, password or IP restriction, you should immediately contact the Komparejet sales team. You agree to cooperate with us to stop further abuse if it occurs. 

3.5. We reserve the right to issue replacement usernames and/or passwords at any time. 

3.6. You do not own any information you have purchased or printed from our product pages or website. You must do your best to protect the intellectual property, confidential information and proprietary rights of Komparejet. 

3.7. Restrictions on Use. You agree not to:  

3.7.1. Sell, distribute, license, rent or exploit in any way any of the Product provided, or any part thereof, for commercial purposes.  

3.7.2. Remove or obscure any copyright notices on any materials, including hard copy printouts 

3.7.3. Use any Product, or any element thereof, to create a derivative work, product or service, or merge any Product with any other product, database or service. 

3.7.4. Alter, amend, modify, translate or change any Product, or any element thereof 

3.7.5. Undertake any activity that may have a detrimental effect on our ability or that of our third party licensors to earn revenue from the sale and marketing of the Products 

3.7.6. Otherwise use any Product, or any element thereof, provided pursuant to this Agreement in a manner that would infringe any copyright or other proprietary rights therein.  

3.7.7. Allow any third party to obtain remote access to any Product.  

3.7.8. Download or allow any third party to download any digital information onto any storage media, including, but not limited to, system servers, USB sticks, hard drives, floppy disks, CD-ROMs and backup tapes.  

3.8. This Agreement relates only to the use of the Komparejet website and membership portal and does not relate to any additional agreements made for each User's individual flights, which are subject to a separate flight agreement with its own terms and conditions. 

4. Booking.  

4.1. Booking with connection. By choosing this option, KOMPAREJET will put you in contact with the operator of the aircraft you have chosen for your flight. KOMPAREJET shall not be held responsible for the unavailability of the aircraft or any other problem arising after the operator has been contacted. The unavailability of the aircraft or any other element after contact has been established shall not entitle the customer to a refund of the service.  

4.2 Booking with assistance. By choosing this option, you opt for Private Jets and Partners to organize the management of your flight from A to Z. After validation of the choice of reservation, the conditions of use of KOMPAREJET will no longer apply and will be replaced by a specific contract between Private Jets and Partners and the client.  

5. Promotional Offers.  

We may occasionally offer special promotional offers, packages and subscriptions ("Offers"). Eligibility for Offers is determined at Private Jets & Partners' sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are not eligible. We may use information such as the device ID, Payment Method, or an account email address used with an existing or recent KOMPAREJET subscription to determine eligibility for Offers. Eligibility criteria and other restrictions and conditions will be disclosed to you when you subscribe to the Offer or in other communications made available to you.  

6.Passwords and Account Access.  

The user who created the Komparejet account and is charged a subscription fee based on the Payment Method selected (the "Account Holder") is responsible for all activity that occurs through their Komparejet account. In order to maintain control of the account and prevent others from accessing the account (including accessing the account's search history information), the Account Holder must maintain control of the Komparejet-enabled devices used to access the service and must not disclose to any other person his/her password or details of the Payment Method associated with the account. You are responsible for updating and maintaining accurate information about your account. We may terminate or suspend your account to protect you, Komparejet or its partners from identity theft or other fraudulent activity.  

7. Force Majeure 

Our failure to comply with any of the terms or conditions of this Agreement due to circumstances beyond our control, including, but not limited to, wars, strikes, floods, government restrictions, power outages, and damage to or destruction of any network facility or service, shall not be considered a breach of this Agreement. 

8.Miscellaneous  

8.1. These Terms & Conditions shall be governed by and construed in accordance with French law.  

8.2. Customer Support. For more information about our service and its features or if you need assistance using your account, please contact Private Jets & Partners' sales department or Komparejet, accessible via the Komparejet.com website.  

8.3. Invalidity. If one or more provisions in these Terms of Use are found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.  

8.4. Modification of the Terms of Use. Komparejet may amend these Terms of Use from time to time. We will notify you at least 30 days before such changes become effective.  

8.5. Electronic Communications. We will send you information relating to your account (e.g., payment authorizations, invoices, password or Payment Method changes, confirmation messages, notifications) only by electronic means, such as by sending an email to the email address you provided to us upon registration.
